Welcome to Quexer. These Terms of Service (“Terms”) govern your access to and use of www.quexer.com, including the mobile application and all related services operated by Graphgate Private Limited (“Quexer”, “we”, “our”, or “us”).

By accessing or using Quexer, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the platform.

1. Definitions

Platform: Quexer website, mobile app, and related services
User: Any individual or entity using the platform (buyers and vendors)
Vendor: A user offering products or services for sale
Quexer: Graphgate Private Limited, operator of the platform

2. Eligibility & Account

Users must be at least 18 years old or use the platform under supervision of a legal guardian.

You agree to provide accurate and updated information and are responsible for maintaining the confidentiality of your account credentials.

All activities under your account are your responsibility.

3. Marketplace Nature

Quexer operates as a technology intermediary connecting buyers and vendors.

  • Quexer is not the seller of products listed by vendors
  • Vendors are solely responsible for product quality, legality, pricing, and fulfillment
  • Quexer does not guarantee product accuracy or vendor performance

4. Vendor Fairness

Quexer maintains a neutral marketplace environment.

  • All vendors, including in-house brands, are treated equally
  • Product rankings are determined by objective factors such as relevance, reviews, and performance
  • No preferential treatment is provided except for disclosed promotional placements

Vendors may raise concerns through the support system. Final decisions are made at Quexer’s discretion.

5. Acceptable Use

Users agree not to:

  • Violate any applicable law or third-party rights
  • Post misleading, false, or fraudulent listings
  • Use bots, scraping tools, or unauthorized automation
  • Disrupt platform operations or security

Quexer may suspend or terminate accounts for violations.

6. Payments, Fees & Refunds

  • Payments are processed through third-party providers (e.g., Razorpay)
  • Quexer is not responsible for payment gateway failures or delays
  • Vendor commissions and fees are disclosed separately
  • Refunds are governed by vendor-specific policies

Quexer may mediate disputes but does not guarantee refunds.

7. Intellectual Property

All Quexer-owned content (including logos, UI, code, and design) is protected by applicable laws.

Users retain ownership of their content but grant Quexer a non-exclusive, royalty-free, global license to use, display, and promote such content on the platform.

8. Data Privacy

User data is handled in accordance with applicable laws and our Privacy Policy.

While reasonable security measures are implemented, Quexer does not guarantee absolute data security.

Users are responsible for safeguarding their account and personal information.

9. Platform Availability

Quexer may modify, suspend, or discontinue any part of the platform at any time.

We do not guarantee uninterrupted or error-free operation and are not liable for downtime or technical disruptions.

10. International Use

Users accessing Quexer from outside India do so at their own risk.

  • Vendors are responsible for compliance with export laws, customs regulations, and international trade requirements
  • Customers are responsible for applicable import duties, taxes, and local regulations

Quexer does not guarantee compliance with foreign laws unless explicitly stated.

11. Dispute Resolution

These Terms are governed by the laws of India.

  • Jurisdiction: Bangalore, Karnataka
  • Users agree to first attempt resolution through Quexer support before initiating legal action

Quexer reserves the right to mediate disputes, with final decisions at its discretion where applicable.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Quexer is not liable for indirect, incidental, or consequential damages
  • Total liability is limited to the value of the transaction in dispute

13. Account Suspension & Termination

Quexer may suspend or terminate accounts in cases of:

  • Policy violations
  • Fraud or abuse
  • Legal or regulatory requirements

Users may request account deletion through support.

14. Policy Updates

These Terms may be updated periodically.

Continued use of the platform after updates constitutes acceptance of the revised Terms.
